1) Overview & Eligibility

• The Service provides digital simulations of makeup on photos and personalized shade recommendations based on tone/undertone analysis. Age: You must be 18 years or older to use the Service. You may use the Service only if you can form a binding contract with us and are not barred under applicable law.

2) Accounts

• You must create an account and keep your credentials confidential. You are responsible for activity under your account. Provide accurate, complete information and update it as needed.

3) Service Requirement: Face Photo

• TrueHue requires a face photo to function. Without a photo, core features (analysis, previews, recommendations) are unavailable. By submitting a photo, you confirm you have the right and all necessary permissions to upload it (e.g., you will not upload someone else’s image without their permission).

4) Your Content & License

• You retain ownership of photos and other content you upload (“User Content”). You grant TrueHue a limited, non-exclusive, revocable license to process and store User Content solely to provide the Service to you (tone/undertone analysis, virtual try-ons, related UX). You must not upload content that is unlawful, infringing, harmful, or that violates others’ rights.

5) Image Processing, Storage & Retention

• Processing location: We process your photo on our servers to analyze skin tone/undertone and to render previews. Storage: Your photo is stored in your account so we can provide ongoing previews and recommendations. Replacement: You may replace your stored photo at any time. Deletion: Your stored photo (and related previews/derivatives under our control) is deleted when you delete your account. No facial recognition/training: We do not use your photo to identify you or others, and we do not use photos to train AI models. We do not sell your photos. Technical caches and CDN copies are purged in the ordinary course of operations following account deletion.

6) Brand Independence

• TrueHue is not affiliated with, endorsed by, or sponsored by any cosmetic brand featured. All product names and trademarks belong to their respective owners and are used for identification only. Shade visuals shown on the Platform are digital approximations created for simulation purposes and may not exactly match the official brand shade or physical product.

7) Acceptable Use

• You agree not to: misuse the Service, interfere with its operation, attempt to access others’ data, or reverse-engineer code; upload unlawful or infringing content; use the Service for commercial purposes without our written permission.

8) Paid Features & Billing (if applicable)

• We may offer paid features or subscriptions. Prices, taxes, and terms will be shown at purchase. If a subscription auto-renews, the renewal terms and how to cancel will be presented at sign-up and available in your account. Except where required by law, fees are non-refundable once digital services are delivered.

9) Third-Party Services

• The Service may link to third-party sites or use third-party processors (e.g., cloud storage). We are not responsible for third-party services; their terms and privacy policies apply.

10) Availability & Changes

• We may modify, suspend, or discontinue the Service (or any part) at any time. We may also update these Terms; continued use after changes means you accept the updated Terms.

11) Warranties & Disclaimers

• Simulations and recommendations are informational only; actual product appearance may vary. Shade representations are digital approximations created for simulation purposes and may not exactly match official brand shade values or the physical product. The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law.

12) Limitation of Liability

• To the fullest extent permitted by law, TrueHue will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our aggregate liability arising from or relating to the Service shall not exceed the amounts you paid (if any) in the 12 months before the claim. Consumer rights that cannot be waived under applicable law remain unaffected.

13) Indemnity

• You agree to indemnify and hold TrueHue harmless from claims arising out of your misuse of the Service, your content, or your violation of these Terms or applicable law.

14) Termination

• You may stop using the Service at any time. We may suspend or terminate access for violations of these Terms or for misuse. Deleting your account removes your stored photo and related previews as described in Section 5

15) Governing Law & Dispute Resolution

• These Terms are governed by the laws of India. Courts in Ahmedabad, Gujarat shall have exclusive jurisdiction for disputes, except that mandatory consumer protections of your country of residence may also apply if required by law.
